ANSWERS:

1.
What is the purpose of this eSign Portal site?

eSign Portal is actually a site that has been around quite awhile. In the past, it was kept private for the research use for our staff and for our customers. Orion decided to make the site public for a number of reasons. First, many of our customers benefited greatly from the use of the site and had asked us to make it public so that others (namely their associates as well as the industry at large) could benefit.  Second, due the maturation of internet, the advent of identity fraud, the continued adoption of highly secure electronic and digital signatures, there is greater need to monitor and disseminate the flow of relevant information from a single source. eSign Portal collects and categorizes highly relevant information into a single, search based site with the sole objective of making your information flow current and concentrated.

The topics that we cover include information on electronic signatures, digital signatures, biometrics, and security. Our topics range from disseminating news information, industry technology and associations, as well as the rules and laws governing the use of the technology, and this industry is heavily governed.  Just take a look at the Laws and Regulations section in the eSign Portal to see the number of US and International laws that have been written expressly about the use of electronic and digital signatures.  All laws point to the proper use of security ( public key, encryption, and hashing algorithms) which is extremely vital when dealing with an individual's personal information and biometrics. We offer guidelines to assist in understanding and adopting the technology. We also offer an Ask the Lawyer form where you can ask one of our legal staff a question at no charge.  Finally, we keep tabs on Identity Fraud and offer an alert notification service for you. We believe that all Identity Fraud can be eliminated with the proper use of Fraud deterrent technology.

The Information Age is in a very early stage with Identify Fraud and Deterrents. There will be many changes (Laws, Rules, Technologies) going forward and eSign Portal can be your guide in keeping abreast of each and every event.

5. What are ID Theft Alerts?

ID or Identification Theft Alerts includes any breach of a person's identification that occurred to the public at large. We monitor such events and will report them in our site and to our registered subscribers when they occur. The reasoning behind this is two fold. First, by being alerted early, if the breach affects you, your chances of protecting your identify and financials greatly improve. Second, we believe that all Identity theft can be avoided by utilizing the appropriate methods and technology. When breaches occur, we have a chance of studying the breach and analyzing the short-comings of the attacked system(s) with the hopes of preventing the breach in the future.

6. How do ID Theft Alerts affect me?

ID Theft Alerts can affect you in many ways. First and foremost, they can affect your financial status and balance. Your credit could be negatively disrupted which would slow down the time it takes to process any loans. It would be encumbered upon you to correct this event with each of the credit institution, possibly with the help of the breached system customer support staff. In either case, this would take time, stalling any credit purchases you may have outstanding.
You could temporarily lose money until the breach is properly managed and the credit institutions replenish your accounts. In most cases, your account is restored in full, however, this can take some time, depending upon the circumstances.

ID Thefts drive up the aggregate cost of doing business.  Whenever there is a breach, the entire industry suffers. The breached system needs to be corrected, the accounts restored, and any residual damage repaired. As more breaches occur, the costs mount and eventually get passed on to customer. By learning how to thwart such breaches, we can begin to reduce the costs.

10. What's the difference between Industry Regulations and Laws?

The Industry Regulations section follows any new set of industry regulations that are administered from a self-governing industry. The Laws section contains laws created by Government.  As an example, when a new VISA or Master Card regulations is defined, it is administered by the industry participants, not Government. However, when a new law is written by the Federal or State Government, it is administered by the court system. To further the point, the US Federal government may create a law that gives some latitude of how a state may interpret and create its own law. This is evident in the E-SIGN Federal Law. States have applied the E-SIGN law very differently from each other. Some states allow the use of electronic signatures for some applications where other states do not. States tend to narrow the scope of a law to applications they see fit. It is important to realize this and research the law if you are doing business in more than one state. Go to our Laws / Regulations Section to begin your research.

Guidelines are written by industry experts to assist you in interpreting rules and laws.  Its important to understand that the are interpretations and that you need to ensure that they follow the rule or law closely. Guidelines are very useful in getting up to speed on a specific subject or implementation, but in no way replaces first hand knowledge and expert advice.
